Section 1 – Scope, Promotion Organiser and Participating Companies

1. These Conditions of Participation (hereinafter referred to as the ‘Conditions of Participation’) apply to the ‘Costa promotion’ (hereinafter referred to as the ‘Promotion’), which will be conducted by the Organiser with the cooperation of third parties (‘Participating Companies’) during the participation period.
2. The Organiser of the Promotion is Costa Coffee (hereinafter referred to as ‘Costa’ or the ‘Organiser’).
3. The companies engaged by Costa to participate in conducting the Promotion are: AIB Merchant Services and Visa Europe Limited (hereinafter referred to individually as a ‘Participating Company’ and collectively as the ‘Participating Companies’).

Section 2 – Eligibility for Participation

1. The following persons are eligible to participate in the Promotion: (i) all holders of a Visa debit and credit card who at the time of their participation have their registered principal place of residence in Republic of Ireland, (ii) who are at least 18 years of age and (iii) who during the participation period (Section 3) fulfil the specific participation requirements (Section 4) for the Promotion (hereinafter referred to individually as a ‘Participant’, regardless of gender, and collectively as the ‘Participants’).
2. Employees of Costa Coffee and of the Participating Companies, their representatives and vicarious agents as well as members of these groups of persons are not entitled to participate in the Promotion.
3. Participants who do not comply with the Conditions of Participation or who are found to commit fraudulent conduct may be excluded from participating in the Promotion.

Section 3 – Participation Period, The Promotion, Offer

1. Participation in the Promotion is possible during the following participation period: from 12:00 a.m. on 1 July 2021 until 11:59 p.m. on 18 July 2021 (local time in Republic of Ireland) or until the maximum number of 13,500 registrations have been completed, whichever is earlier (“Participation Period“).
2. Participants must register their name, email address and Visa debit or credit card on www.visa.ie/costapromo to be eligible for the promotion. Following successful registration, they must make a minimum of three contactless payments with their registered Visa debit or credit card in participating Costa stores within the promotion period. Cardholders who qualify will then be sent a timed coupon via email (by Visa) within 31 days of the promotion end date. The timed coupon can be used to redeem the free sustainable cup from any Costa Coffee store in the Republic of Ireland (subject to availability). The timed coupon is valid for 21 days from the date the email was issued.

Section 4 – Conditions of Participation, Conducting the Promotion

1. Individuals within the meaning of Section 2, Clause 1 who are holders of a Visa card issued by an Irish bank or a credit card issuing company whose headquarters are in Ireland and who register once for participation in the Promotion at www.visa.ie/costapromo, may participate in the Promotion.
2. Visa and its associated companies and service providers will collect, store and process personal data provided by the Participants during registration for the Promotion exclusively for the purpose of performing and accomplishing the Promotion. For this purpose, the Participant’s first and last name, email address and the 16-digit card number of the Participant’s Visa Card must be provided. After the Promotion has ended, the personal data will be deleted.
3. Visa processes personal data as necessary for the performance of a contract (as set out in these Conditions of Participation). Otherwise, Visa processes personal data in accordance with Visa’s Global Privacy Notice https://www.visa.ie/legal/privacy-policy.html  
4. During the Promotion period, Visa will send you information about the Promotion by email. If you do not wish to receive these emails, you can unsubscribe at any time using the link at the bottom of these emails. Please note that if you are a qualifying Participant and you unsubscribe before Visa has sent your timed coupon via email, you may not be able to receive the coupon and redeem your prize.
5. Participants have various rights under data privacy laws (including the right to: ask for a copy of the information that Visa holds about you; ask Visa to update your personal information, if it is incorrect or incomplete; object to Visa’s processing of your personal information; and ask Visa to delete or restrict your personal information). Participants also have the right to file a complaint with Visa or with a supervisory authority if you believe that Visa has processed your personal information in violation of the applicable law. Participants can find more information on Visa’s processing of personal information, and your data privacy rights, in Visa’s Global Privacy Notice.
6. These Conditions of Participation and Visa’s Global Privacy Notice must also be accepted by ticking the box during registration.
7. When Participants in the promotion make three (3) payment transactions with their Visa debit or credit card, they will be eligible to redeem their sustainable cup, provided that the transactions take place after successful registration during the participation period and subject to availability of the cups.
8. Only transactions made after successful registration as defined in Section 3 Clause 2 will be taken into account. No minimum purchase amount is required. No cash alternative.
   
   Only Visa transactions are entitled for the Promotion.
   
   If your Visa card is registered as lost or stolen at any point during the offer period, please note that some transactions may be voided or cancelled as part of this process and if so will not count as qualifying transactions.
9. Participants may only participate in the Promotion with their own Visa Card. The first name and last name specified during registration must match the first name and last name on the Visa Card. Participants who wish to use a Visa Corporate Card or Visa Commercial Card must obtain the consent of their employer before participating in the Promotion and must provide written proof of this consent upon request. It is the responsibility of the Visa Corporate Card or Visa Commercial Card holder to declare the refunds from the Promotion as taxable income (monetary advantage). Visa Cards reissued after the loss or theft of the Visa Card which was registered for the Promotion will not be automatically considered for the Promotion. Every participant is entitled to register only one Visa Card per email address for the promotion.
10. Costa Coffee and the Participating Companies shall not be liable for any delay in registration caused by circumstances beyond their control, whether due to technical problems, computer malfunctions or errors.

Section 5 – Termination of the Promotion

1. Costa Coffee reserves the right to suspend, cancel or terminate the Promotion in whole or in part before the end of the Participation Period if circumstances beyond their control so require. Costa Coffee may exercise this right in particular in the event of viruses, hacker attacks and other unauthorised access by third parties or if there are software errors on the Promotion’s website or if the integrity and objectivity or the correct and proper execution of the Promotion are significantly impaired.
2. The suspension, cancellation, or premature termination of the Promotion shall not entitle Participants to any claims whatsoever, and in particular, to any claims for refunds.

Section 6 – Miscellaneous

1. Should individual provisions of these Conditions of Participation be or become invalid, this shall not affect the validity of the remaining Conditions of Participation. The parties shall replace the invalid or ineffective provisions with provisions that correspond as closely as possible to the original intention of the parties.
2. The Promotion is subject to the law of the Republic of Ireland.
